Terms of Service
The short version. leadcheckers receives the submissions of web forms you connect to it, shows them in your dashboard and emails them to you. Your subscription renews automatically until you cancel, and you can cancel any time from your account. Lifetime plans are paid once and never renew. Payments are not refundable, except where the law requires. You are responsible for the forms you connect and the data they collect. This summary doesn't replace the terms below.
1. Who we are and this agreement
leadcheckers is operated by a company organized under the laws of Brazil ("leadcheckers", "we", "us"). You can reach us at the support address shown in your account.
These Terms are a binding agreement between you and us. You accept them at checkout and when you use the service. The version you accepted, and when, is recorded with your account. You must be at least 18 and able to enter into a contract. If you use the service for a business, you accept these Terms on its behalf.
2. The service
leadcheckers gives you integration addresses ("form addresses") that web forms can send submissions to. Submissions are stored in your dashboard, organized by the sites you create, checked for spam, and emailed to the recipients you choose. You can export them as CSV.
Spam filtering is automatic and imperfect: real submissions can be filed as spam and spam can get through. Check the Spam folder of each site. Email alerts depend on the recipient's mail provider; the dashboard is the record of what was received.
Each plan includes a number of sites and a monthly number of email alerts. Submissions past the monthly number are still stored and shown; only their email alert is skipped. We may limit or block traffic that endangers the service (floods, abuse), and file or reject submissions that trip our safety checks.
3. Plans, billing and automatic renewal
- Prices. Plans are billed weekly, monthly or yearly in US dollars, as shown at checkout. Introductory discounts apply to the first payment only; renewals are charged at the regular price.
- Automatic renewal. Your subscription starts when the first payment is approved and renews automatically for another period of the same length at the price then in effect, until you cancel. By subscribing, you authorize us and our payment processor, Stripe, to charge your payment method for each period and for any upgrade you choose.
- Lifetime plans. Paid once, never renewed. "Lifetime" means for as long as we operate leadcheckers. If we ever shut it down, we'll email you at least 90 days in advance so you can export your data.
- Plan changes. Upgrades and downgrades take effect immediately; the prorated difference is charged or credited by Stripe.
- Failed payments. If a renewal fails, Stripe retries for a few days and your forms keep working meanwhile. If it still fails, the subscription ends as described in section 4.
- Taxes. Prices don't include taxes unless stated.
4. Cancellation and what happens after
Cancel any time from your account page. Your forms keep working until the end of the period you paid for and you won't be charged again. When the subscription ends, your forms stop accepting submissions and your sites, forms and stored submissions are deleted 30 days later. Export what you need before that.
5. Refunds
The service starts as soon as you pay, so payments are not refundable, in whole or in part, except where the law requires. If a charge looks wrong, write to the support address shown in your account before contacting your bank; we answer within 3 business days and will fix our mistakes.
6. Acceptable use
You may only connect forms on websites you own or are authorized to manage. You may not use leadcheckers to:
- collect passwords, full card numbers, bank credentials, government ID numbers or health records;
- run phishing, impersonate others, or collect data under false pretenses;
- collect data about children, or any data illegally;
- send, relay or store spam, malware or unlawful content;
- overload, probe or attack the service, or get around its limits.
We may suspend forms or accounts that break these rules, immediately when there's a risk to people or to the service, and close them without refund in serious cases.
7. The data your forms collect
For the submissions your forms collect, you (or your client) are the controller and we act as processor on your behalf: we store, filter, show and email them only to provide the service, and never sell them or use them for anything else. You are responsible for having a legal basis to collect that data, for telling the people who fill in your forms how it's used (for example, in the site's privacy policy), and for answering their requests. Our Privacy Policy explains what we keep and for how long.
8. Availability and liability
We work to keep leadcheckers available and your data safe, but the service is provided "as is", without a guarantee that it will be uninterrupted or error-free. To the extent the law allows, we aren't liable for lost profits, lost leads or business, or indirect damages, and our total liability is limited to what you paid us in the 3 months before the event. Nothing here limits rights you have under consumer law that can't be waived.
9. Changes and law
We may update these Terms. For material changes we'll notify you by email at least 15 days in advance; continuing to use the service afterwards means you accept them. These Terms are governed by the laws of Brazil.
